At Olga Biemolt Photography, we take the protection of both your personal data and our intellectual property (photographs) very seriously. This policy outlines the rights you have regarding the photographs we capture for you, as well as how we retain and manage those images according to Irish Law.

By hiring us as your wedding photographers, you acknowledge and agree to the terms of this policy.

1. Ownership of Images

All photographs taken by Olga Biemolt Photography are the copyrighted property of Olga Biemolt Photography, as protected under the Copyright and Related Rights Act 2000 in Ireland. This means that:

We retain the copyright over all images, even once you receive digital files or prints.
You receive a licence to use the images for personal, non-commercial purposes as outlined below. You do not own the copyright to the images.

2. Client Usage Rights

Upon payment and delivery of your photographs, you are granted the following rights:

Personal Use: You may print, share, and display the images for personal, non-commercial use. This includes using the photos for personal albums, social media posts, and printing for personal gifts.
Social Media: You may share images on social media platforms, provided you credit Olga Biemolt Photography as the photographer (e.g., “Photography by Olga Biemolt Photography” or “Photo by Olga Biemolt Photography”). We encourage you to tag us to help us showcase our work.
No Commercial Use: You may not use the images for any commercial purposes (e.g., advertising, marketing, or resale). If you wish to use images for commercial purposes, you must obtain prior written consent from us and may be required to pay additional licensing fees.

Examples of Commercial Use include, but are not limited to:

Using the images in business marketing or promotional materials.
Selling prints or digital copies of the images.
Using images in advertisements, websites, or other business activities.

3. Commercial Use & Licensing

If you wish to use the images for any commercial purposes (e.g., promotional materials, ads, product packaging, or resale), you will need to request a separate licence from us. We will provide a written agreement specifying the terms and any associated licensing fees.

Without such an agreement, any commercial use of the images is strictly prohibited.

4. Model Release

By hiring our services, you grant us the right to use photographs from your wedding for the following purposes:

Portfolio and Marketing: To showcase the images on our website, social media platforms, and other marketing channels.
Publicity: To use the images in advertising materials, magazine publications, or competitions.

If you do not wish for us to use specific images publicly, you must inform us in writing prior to your wedding date. While we respect your privacy, we may still use images for self-promotion unless explicitly restricted by you.

5. Editing and Modifications

Once delivered, you may not modify, crop, or edit the images in a way that could alter their original artistic intent.
If you request edits or retouching (e.g., color adjustments, cropping), we can make those adjustments, and additional fees may apply.

6. Delivery, Storage, and Protection of Images

Your wedding photographs will be delivered in digital format (via an online gallery or USB drive) and will include high-resolution and web-sized versions.
We will store your images for a reasonable period to ensure you have access to them. However, we do not guarantee indefinite storage. It’s important to download your images promptly upon receipt.

We will also place a watermark or copyright notice on certain images for protection. Once you receive the full-resolution files, the watermark will be removed for personal use.

7. Privacy and Data Protection (GDPR Compliance)

We take your privacy seriously and comply with GDPR and Irish data protection laws. If any images involve identifiable people (yourself, guests, etc.), we will ensure that these individuals understand and consent to the use of their images for portfolio and promotional purposes.

Consent for Use: As per GDPR, you grant us explicit consent to process and use the images for promotional activities as outlined above.
Your Rights: You have the right to request removal of images from our website or social media. If you have concerns about how your personal data (i.e., identifiable images) is used, please contact us to exercise your rights under GDPR, including the right to withdraw consent or request deletion.

8. Copyright Protection and Restrictions

In accordance with Irish Copyright Law, images taken by Olga Biemolt Photography are protected under the Copyright and Related Rights Act 2000. This means:

Reproduction and Distribution: You may not reproduce or distribute the images (whether online or in print) for any commercial purposes without obtaining a written licence from us.
Infringement: Any unauthorized use of our images may lead to legal action to protect our copyright and intellectual property rights.

9. Credits and Tags for Social Media

When sharing your wedding images on social media, we request that you provide credit for our work. Please tag us wherever possible on platforms like Instagram, Facebook, and Twitter to help us promote our work.

You are purchasing a licence to use the images for personal, non-commercial purposes, while copyright remains with Olga Biemolt Photography. This ensures that we retain control over how our work is used and shared.

The images from your wedding may be made available through an online gallery hosted by Olga Biemolt Photography for you and your guests to view and purchase prints. Please note that the copyright remains with us, and we reserve the right to sell prints through this gallery. You and your guests are welcome to purchase prints, but may not reproduce them for commercial purposes without our consent.

16. Non-Refundable Deposit & Cancellation Terms (Highlighted Addition)

To secure your wedding photography booking, a non-refundable deposit is required. If you cancel your booking prior to the wedding date, the deposit will not be refunded. However, if unforeseen circumstances (e.g., illness, extreme weather conditions) prevent us from providing our services, we will offer an alternative photographer or a full refund, depending on the situation.
